1. SCOPE OF APPLICATION

These General Terms and Conditions of Sale (hereinafter "GTC") apply, without restriction or reservation, to all sales made on the Maison Villevert website and concluded between the company Maison Villevert, a simplified joint-stock company with a capital of 3,453,155 euros, whose registered office is located in MERPINS (16) – Villevert, registered with the Trade and Companies Register of ANGOULÊME, under number 524 935 301 (hereinafter "Maison Villevert") and any buyer, a natural person, of legal age, providing a postal address in metropolitan France excluding Corsica (to be adapted according to the carrier) and contracting in a non-professional capacity (hereinafter "the Customer").

They specify in particular the conditions of ordering, payment, delivery and handling of any returns of Products ordered by the Customer and are accessible at any time on the Maison Villevert website.

These General Terms and Conditions of Sale may be subject to change, the version applicable to the Customer's purchase being the one in effect on the website on the date of order validation.

2. LEGAL AGE AND SALE OF ALCOHOL

In accordance with French law, the sale of alcohol to minors is prohibited. Therefore, by purchasing alcoholic beverages on the Maison Villevert website, the Customer declares that they are of legal age, i.e., 18 years or older, and accepts that a valid form of identification may be requested upon delivery, if necessary.

  • By visiting the website, the Customer certifies that he/she is 18 years of age or older.
  • Age verification: In case of doubt, Maison Villevert reserves the right to request age verification from the Customer before shipping the order.

3. PRODUCTS

The products offered for sale on the Maison Villevert website are mainly, but not limited to, alcoholic and non-alcoholic beverages, glasses and cocktail accessories, the main characteristics of which include all the substantial information required by applicable regulations and are presented on the site.

The product offers shown are those displayed on the website on the day of consultation and are subject to availability. Maison Villevert reserves the right to modify the product range at any time based on availability constraints.

The Products are presented as accurately as possible. However, product photographs are not contractual. The colors and appearance of the Products may vary from what is displayed on screen.

4.1 Order cancellation by Maison Villevert

Maison Villevert reserves the right to cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order or for any other reason relating to the abnormal nature of the order, at the discretion of Maison Villevert.

To limit fraud and in the interest of its customers, Maison Villevert verifies all orders placed on its website. Therefore, if there is any doubt about the authenticity of an order, Maison Villevert reserves the right to request proof of identity (passport, national identity card, or driver's license) before accepting the sale. In this case, your order will be processed upon receipt of these documents. Maison Villevert also reserves the right to cancel your order if these documents are not received within 10 days or if the documents received are deemed non-compliant.

4.2 Product unavailability

In the event of product unavailability not reported at the time of ordering, the Customer will be informed by email as soon as possible.

The Customer may be offered a refund within a maximum of 15 working days.

4.3 Pre-contractual information

The Customer acknowledges having been informed by the Seller in a legible and understandable manner, by means of making these General Terms and Conditions available, prior to their immediate purchase or placing the order and in accordance with the provisions of Article L 221-5 of the Consumer Code:

  • Regarding the essential characteristics of the Products, including specifications, illustrations, and indications of dimensions or capacity, the Customer is responsible for making an informed purchase, particularly concerning their conditions of use. Photographs and graphics are not contractual and do not constitute a guarantee by the Seller. The Customer is required to refer to the description of each Product to understand its essential properties and characteristics.
  • Regarding the price of the Products and related costs;
  • Regarding the terms of payment, delivery and execution of the sales contract;
  • Regarding the identity of the Seller and all of his/her contact details;
  • Regarding the existence and implementation methods of guarantees (the legal guarantee of conformity, the guarantee against hidden defects);
  • Regarding the possibility of using a consumer mediator, whose contact details are included in these General Terms and Conditions, under the conditions provided for in the Consumer Code;
  • Regarding the right of withdrawal (existence, conditions, time limit, procedures for exercising this right and standard withdrawal form), the terms of termination, the handling of complaints and other important contractual conditions;
  • Regarding accepted payment methods

    Placing an order on the Maison Villevert website by a Customer implies full and complete acceptance of these General Terms and Conditions of Sale and an obligation to pay for the Products ordered, which is expressly acknowledged by the Customer, who waives, in particular, the right to rely on any contradictory document, which would be unenforceable against the Seller.

5. PRICE

Product prices are indicated in euros and include all taxes (TTC).

The prices charged are those indicated at the time the customer's order is validated. Maison Villevert reserves the right to modify the prices indicated on its website at any time.

The total amount of the order, including delivery charges, is specified at the time of order confirmation.

6. PAYMENT

The price is payable in full, in cash, on the day the order is validated, via secure payment using the following payment methods:

  • Bank card (Visa, MasterCard)
  • Apple Pay
  • Other payment methods are available on the website.

Payment will be processed in a secure environment that guarantees the confidentiality of the customer's banking information. During the final validation phase, the customer will be required to enter their credit card number, expiry date, and the security code located on the back of the card. Their PIN will never be requested. This information is entered in encrypted fields, and all transmitted data is encrypted using the TLS protocol.

Credit card payments are debited at the time of order validation, provided that prior authorization to debit the customer's account has been obtained from the relevant payment centers, otherwise the order cannot be taken into account.

Payments made by the Client will only be considered final after Maison Villevert has effectively received the sums due.

7. DELIVERY

The delivery time includes both order preparation and shipping. Order preparation takes 48 to 72 hours from the date the customer receives order confirmation.

For shipments within mainland France (excluding Corsica), the average delivery time is indicated below, depending on the chosen delivery method. The maximum legal delivery time is 30 days from the date of online purchase, except in cases of force majeure:

  • Home delivery within 48/72 hours from order dispatch confirmation for shipments within France (excluding public holidays and Saturdays/Sundays)
  • Delivery to a collection point/locker: 24/48 hours from the order dispatch confirmation for shipments within France (excluding public holidays and Saturdays and Sundays)

These delivery times are indicative only and subject to product availability. In the event of a foreseeable delay in shipping, Maison Villevert undertakes to inform the Customer as soon as possible by any means so that the Customer can choose to maintain or cancel their order.

All delivery options are subject to a charge payable by the Customer, unless otherwise specified by Maison Villevert. Delivery charges will be detailed in the order summary, based on the Customer's chosen delivery method. Delivery will be made to the delivery address provided by the Customer.

Deliveries only take place during the operating hours of the transport companies; no deliveries are possible on Sundays or public holidays.

In the event of force majeure, Maison Villevert reserves the right to ship its packages via registered mail (shipping costs will, in all cases, be calculated according to the same price list). Maison Villevert cannot be held liable for the consequences of any events beyond its control, including force majeure or actions of the carrier, that may delay or prevent the delivery of ordered products.

The delivery delay shall not, under any circumstances, entitle the Customer to compensation or damages. Maison Villevert reserves the right to split deliveries, it being understood that shipping costs will only be charged once.

Delivery tracking
The Customer will be able to track the delivery of their order by clicking on the tracking link provided in the order dispatch email or via the link sent directly by the carrier.

Product conformity upon delivery
Maison Villevert advises the Customer to refuse any damaged package and to notify its Customer Service department of their reservations in writing and in detail upon receipt of the goods, retaining proof of their written notification. Otherwise, Maison Villevert will consider that the Customer has received the products in a condition that fully satisfies them.

8. RIGHT OF WITHDRAWAL

In accordance with applicable legal provisions, the Customer has a period of fourteen days from receipt of the Products to exercise their right of withdrawal with Maison Villevert, without having to provide reasons or pay any penalty, for exchange or refund. When the period expires on a Saturday, Sunday, or public holiday, it is extended until the next working day.

The right of withdrawal can be exercised by sending the form provided for this purpose (at the bottom of the page):

  • By registered letter with acknowledgment of receipt addressed to the Customer Service Department of Maison Villevert Site d'Adéona, 2 Rue des Vendanges, 16130 Salles d'Angles
  • Or via email at adv@maisonvillevert.com by completing the online questionnaire. An acknowledgement of receipt will then be sent to the Client.

    Maison Villevert will then contact the Client as soon as possible to process their request and, if necessary, offer an alternative.

    If Maison Villevert confirms the withdrawal request, the Customer has 14 days from the date of confirmation to return the Product(s) in question. Returns must be made in their original and complete condition (packaging, accessories, instructions, etc.) allowing them to be resold as new, accompanied by proof of purchase, to the following address: Maison Villevert Site d'Adéona, 2 Rue des Vendanges, 16130 Salles d'Angles, France.

    If the right of withdrawal is exercised within the aforementioned period, only the price of the purchased product(s) will be refunded. Return shipping costs are the responsibility of the customer.

    The refund will be processed within a maximum of 14 days, provided the Products are received in their original condition and complete. The refund will be issued via the same payment method used for the initial transaction.

    No product may be returned to Maison Villevert without prior notification and in accordance with its return shipping instructions.

9. TRANSFER OF OWNERSHIP – TRANSFER OF RISK

Ownership of Maison Villevert Products will transfer to the Customer after full payment of the price by the Customer and upon delivery of said products.

Maison Villevert is responsible for delivering the sold Product to the location designated by the Customer, via a carrier; the risk of loss or damage to the Product will only be transferred to the Customer when the latter actually takes possession of the Products (without prejudice to any recourse that Maison Villevert may have against the carrier responsible for making the delivery).

10. COMPANY LIABILITY AND GUARANTEES

The Products sold on the Maison Villevert website comply with the regulations in force in France and with the description made on the merchant site on the day of the order.

As the Products are not intended for a professional clientele, Maison Villevert cannot, under any circumstances, be held liable for any damage, of any kind whatsoever, resulting from a Product that the Client has acquired for purposes within the scope of a professional activity.

10.1 Legal Guarantees

All Maison Villevert products offered on the site benefit from the legal guarantee of conformity provided for in articles L. 217-4 to L. 217-14 of the Consumer Code and the legal guarantee against hidden defects provided for in articles 1641 to 1649 of the Civil Code.

Under these guarantees, Maison Villevert undertakes, according to the Customer's choice, to refund or exchange the products:

  • apparently defective, damaged or broken, or not as ordered,
  • against hidden defects arising from a flaw in material, design or manufacturing affecting the delivered products and rendering them unfit for use.

If the product(s) delivered does/are not in conformity with the order, you must send, within a reasonable time after receipt, a written request to Maison Villevert in order to obtain a refund or replacement of the product(s).

As a reminder, the warranties attached to the products sold on our site are set out in the following articles:

Article L217-4 of the Consumer Code
"The seller must deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter was the seller's responsibility under the contract or was carried out under the seller's supervision."

Article L217-5 of the Consumer Code
"The property conforms to the contract:"

1° If it is suitable for the purpose usually expected of similar goods and, where applicable:

  • if it corresponds to the description given by the seller and possesses the qualities that the seller presented to the buyer in the form of a sample or model;
  • if it possesses the qualities that a buyer can legitimately expect, having regard to the public statements made by the seller, the producer or their representative, particularly in advertising or labelling;

2° Or if it possesses the characteristics defined by mutual agreement between the parties or is suitable for any special purpose sought by the buyer, which has been brought to the seller's attention and accepted by the latter.

Article L217-12 of the Consumer Code
"The action resulting from a lack of conformity is time-barred two years from the date of delivery of the goods."

Article 1641 of the Civil Code
"The seller is bound by a warranty against hidden defects in the thing sold which render it unfit for its intended use, or which diminish that use to such an extent that the buyer would not have acquired it, or would have given only a lower price, if he had known of them."

Article 1648 al 1st civil code
"The action resulting from latent defects must be brought by the buyer within two years of the discovery of the defect."

10.2 Commercial warranty provided by the manufacturers

In addition to the aforementioned legal guarantees, some goods offered on the website may be covered by a manufacturer's commercial warranty, which varies depending on the product. This commercial warranty is not provided by Maison Villevert but directly by the product manufacturer.

To find out more and to be able to benefit from this guarantee, the Customer must contact the manufacturer concerned directly, and not Maison Villevert.

In any case, Maison Villevert cannot be held responsible if the builder refuses to apply its guarantee for the reasons set out above.

10.3 Exclusion of warranties


All warranties are excluded in the event of misuse, negligence or lack of maintenance by the Customer, as well as in the event of normal wear and tear of the product, accident or force majeure.

The warranty is limited to the replacement or refund of non-conforming or defective products. The customer is solely responsible for the choice of products, their storage, and their use in accordance with the instructions for use.

No commercial warranty is given by Maison Villevert in addition to the legal warranties.

11. PROTECTION OF PERSONAL DATA AND COOKIES

In accordance with Law 78-17 of January 6, 1978, as amended by Law No. 2018-493 of June 20, 2018, please note that the data requested from the Customer is necessary for processing their order and issuing invoices, among other things. The processing of information provided through the Maison Villevert website complies with legal requirements regarding the protection of personal data, and the information system used ensures optimal protection of this data.

In accordance with applicable national and European regulations, the Client has a permanent right of access, modification, rectification, objection, portability and limitation of processing with regard to information concerning him/her.

This right can be exercised under the conditions and according to the procedures defined on the Maison Villevert website in its Privacy Policy section.

12. INTELLECTUAL PROPERTY

The Maison Villevert website and each of its components (such as trademarks, domain names, texts, site maps, software, animations, images, photographs, illustrations, packaging, diagrams, logos, sounds and music) are the exclusive property of Maison Villevert or third parties who have duly authorized Maison Villevert to use these elements, which is the only entity authorized to use the related intellectual property rights.

No element of the site may be used, reproduced, distributed or published in whole or in part without prior written authorization from Maison Villevert, with the exception of all downloadable content on the Press Area.

13. CONSUMER COMPLAINTS AND MEDIATION

In the event of a complaint or dispute concerning a product, the Customer may refer to the FAQ published online by Maison Villevert. If this FAQ does not answer their questions, they should contact the email address adv@maisonvillevert.com .

In the event that an amicable settlement of the dispute between Maison Villevert and the Customer fails, and in accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, Maison Villevert subscribes to the mediation service Centre de Médiation et d'Arbitrage de Paris (CMAP), to which it is affiliated. The mediator can be contacted electronically at consommation@cmap.fr or by mail at 39 Avenue Franklin D Roosevelt, 75008 Paris, France. The Customer may contact this mediator free of charge to seek an amicable resolution of the dispute.

14. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions and the transactions arising therefrom are governed by French law.

They are written in French. In the event that they are translated into one or more languages, only the French text shall prevail in the event of a dispute.

All disputes arising from purchase and sale transactions concluded under these general terms and conditions of sale, concerning their validity, interpretation, execution, termination, consequences and subsequent effects, which could not be resolved between Maison Villevert and the Client or following referral to the aforementioned Consumer Mediator, shall be submitted to the competent courts under the conditions of common law.
